Terms of Service
These Terms govern your use of ExecBot, an invitation-only AI chief-of-staff service operated by POWER OF 28 LLC ("ExecBot", "we", "us"). By creating an account or using the service you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.
1. The service
ExecBot provides an AI orchestrator ("Atlas") and configurable specialist agents, briefings, automations, memory, and related features. Access is by invitation. ExecBot is bring-your-own-key: model inference runs against API keys you supply, under your own agreement with the model provider, and you are responsible for those provider costs. ExecBot's built-in spend controls (daily caps, meters) are conveniences, not guarantees of cost.
2. Accounts and eligibility
You must be at least 18 and using the service for business purposes. You are responsible for safeguarding your account and for all activity under it. We may suspend accounts that present a security risk or violate these Terms.
3. Subscriptions and billing
Paid plans are billed monthly or annually per the pricing presented at purchase, via Stripe or by invoice. Annual plans are billed up front. Fees are non-refundable except where required by law. Plan features may evolve; we will not materially reduce what a paid plan includes during a paid term. Taxes are your responsibility where applicable.
4. Acceptable use
You agree not to use ExecBot to violate law, infringe others' rights, send spam or unauthorized messages, attempt to breach tenant isolation or probe the service's security, resell access, or develop competing models from service output. Gmail-connected automations may only be used with mailboxes you are authorized to operate. You are responsible for the instructions you give your agents and for reviewing outbound actions you approve.
5. Your content
You retain all rights to content you submit. You grant us a limited license to host and process it solely to provide the service to you. We do not use your content to train AI models, and we do not sell it. AI-generated output may be inaccurate; you are responsible for reviewing it before relying on or sending it.
6. Third-party services
The service interoperates with third parties — Google (sign-in, Gmail), your model provider (e.g., Anthropic), ElevenLabs, Stripe — each under their own terms. Connecting them is optional and revocable. We are not responsible for third-party services.
7. Availability; beta features
We aim for high availability but the service is provided "as is" and "as available", without warranties of any kind, express or implied. Features marked as early or beta may change or be withdrawn.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and our aggregate liability arising out of the service is limited to the fees you paid to us in the twelve months preceding the claim. Nothing here limits liability that cannot be limited by law.
9. Indemnity
You will defend and indemnify us against third-party claims arising from your content, your use of connected accounts, or your breach of these Terms.
10. Termination
You may cancel at any time, effective at the end of the current billing term. We may suspend or terminate for material breach. On termination you may request an export of your data; Section 6 of the Privacy Policy governs deletion.
11. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located there.
