Terms of Service

These Terms govern your use of ExecBot, operated by POWER OF 28 LLC ("ExecBot", "we", "us"). ExecBot provides AI-powered automation services in three forms: one-time reports such as the Cold Audit, bought without an account; automations we build and run for you under a written scope; and an invitation-only platform for members. By placing an order, agreeing a scope, or creating an account you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.

1. The services

ExecBot runs crews of AI agents that read data, carry out a defined job, write up the result and deliver it, usually by email. Which parts of these Terms apply depends on how you use us: Section 2 for one-time reports, Section 3 for automations we run for you, Section 4 for platform accounts. Sections 5 to 13 apply to everyone.

2. One-time reports (the Cold Audit)

What you buy. One report on one business that you name, prepared from publicly available information (your website, your Google listing and reviews, public search and AI answers, and the public listings of nearby businesses) together with the answers you give to our questions. We do not connect to your accounts. Information we cannot find publicly is marked as missing rather than assumed.

Delivery. By email, as a private link that stays available for 90 days. Within the first hour we may email you a few questions, open for 48 hours. The report arrives within 48 hours of your answers; if the questions go unanswered, it proceeds without them and arrives within 48 hours of them closing. Keep your own copy once it arrives.

Nature of the report. The report is generated by AI. It is information and opinion to help you decide, not legal, financial, marketing or other professional advice, and we do not guarantee any business result from acting on it. Statements about other businesses come from public sources as they stood on the day and are provided for comparison only.

Licence. You may use the report within your own business and share it with your staff, advisers and agencies. You may not resell it, offer it as your own product, or publish it in full.

Price and payment. The price shown at purchase, in US dollars, paid by card through Stripe. Taxes are added where Stripe Tax requires them. You confirm that you are at least 18 and buying for business purposes.

Refunds. One rule, and it is the only one. If we cannot run the audit, for example because no Google listing matches the details you gave, we stop, tell you by email and refund the full amount without your having to ask. Refunds go back to the card that paid. Once a report has been delivered it is not refundable.

If you are a consumer in the EU or the UK: by ordering you ask us to begin work immediately. You keep the right to cancel for 14 days, but once the report has been delivered that right is lost.

3. Automations we run for you

When we build and run an automation for your business, a written scope agreed by email sets out what it reads, which crew runs it, when it runs, what it delivers, the price, and any data you give us access to. The scope governs those points; these Terms govern everything else. You confirm you are entitled to give us access to any mailbox, account or data named in the scope, and you may withdraw that access at any time. Outputs are AI-generated and reviewed as the scope says; you are responsible for reviewing them before acting on them or sending them on.

4. Platform accounts

Access to the ExecBot platform is by invitation. Members use an AI orchestrator ("Atlas") and configurable specialist agents, briefings, automations, memory and related features. The platform is bring-your-own-key: model inference runs against API keys you supply, under your own agreement with the model provider, and you are responsible for those provider costs. Our spend controls (daily caps, meters) are conveniences, not guarantees of cost. You must be at least 18 and using the service for business purposes. You are responsible for safeguarding your account and for all activity under it; we may suspend accounts that present a security risk or violate these Terms. Where a paid plan applies, it is billed per the pricing presented at purchase, via Stripe or by invoice; plan fees are non-refundable except where required by law, and we will not materially reduce what a paid plan includes during a paid term.

5. Acceptable use

You agree not to use ExecBot to violate law, infringe others' rights, send spam or unauthorized messages, attempt to breach tenant isolation or probe the service's security, resell access, or develop competing models from service output. Email-connected automations may only be used with mailboxes you are authorized to operate. You are responsible for the instructions you give your agents and for reviewing outbound actions you approve.

6. Your content and the outputs

You retain all rights to content you submit. You grant us a limited licence to host and process it solely to provide the service to you. We do not use your content to train AI models, and we do not sell it. AI-generated output may be inaccurate or incomplete; you are responsible for reviewing it before relying on or sending it.

7. Third-party services

The service interoperates with third parties, each under their own terms: Google (sign-in and, for members who connect them, Gmail, Search Console and Analytics; Google Maps Platform and PageSpeed data in reports), your model provider or ours (Anthropic), ElevenLabs, and Stripe. Connecting an account is optional and revocable. We are not responsible for third-party services.

8. Availability; early features

We aim for high availability but the service is provided "as is" and "as available", without warranties of any kind, express or implied. Features marked as early or beta may change or be withdrawn.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages. For a one-time report, our aggregate liability is limited to the price you paid for that report. Otherwise it is limited to the fees you paid to us in the twelve months preceding the claim. Nothing here limits liability that cannot be limited by law.

10. Indemnity

You will defend and indemnify us against third-party claims arising from your content, your use of connected accounts, or your breach of these Terms.

11. Termination

Members may cancel at any time, effective at the end of the current billing term. Either party may end an automation arrangement as its scope says, or on 30 days' notice where it says nothing. We may suspend or terminate for material breach. On termination you may request an export of your data; the Privacy Policy governs deletion.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located there. If you are a consumer, nothing here removes protections you have under the law of the country where you live.

13. Changes; contact
